given the public concern about our investigatory budget, given that the public wants us to do more investigations based on certainly what we hear in front of us, i would be fine with you doing what you have typically done and not proposed a budget cut. i think certainly the public relies on us to some extent for our investigatory work and we want to continue that and certainly not diminish that result of budget cuts, in my opinion. any other comments? is there public comment on this matter? >> david pilpel, a number of items starting with memo. i don't know why commissioner renne fell off the letterhead here. i apologize and i hope he is still with us and perhaps it's just an oversight. plus the date should be 2013. this is actually not a lot of detail. it's like no detail. and this is actually a required annual hearing on the budget pursuant to the charter. i appreciate commissioner hayon's question and the director's answer. i think in whatever transmittal comes from the commission and the staff to the mayor and controller should include some of the that language about things
the carpenters for highlighting us in the january edition of the magazine. they have a really nice article in there about the transbay project and the importance of labor in their continued support to our project over many years, thank you very much for acknowledging us and the magazine. and in addition, board members, i did sign out a letter from anvill builders as you may recall. it is a company that we awarded a contract to in november of last year for 9, 250,000, million, and they sent a letter thanking us for all of the work that we are doing regarding minority owned business and i want to thank everyone because we are doing a good job in that area. in addition, i wanted to report that last saturday, there was a very tragic incident that occurred on third street where a bicyclist was killed in a collision with a cement truck. and i know that our chair person kim has been very concerned about traffic and safety for pedestrians and bicyclists which is busy in that area understandable because we have a lot of events and on that particular day was an appreciation day and so we have asked
to pay for a third reviewer. it is very expensive, it was done by the u.s. security team and done by dbs and a whole slew of other consultants. we don't have the funding to bring in yet a third reviewer, but what we can do is we can be presented this to our funding partners and to the fra and the fta and happy to bring you any comments that they may have. we have many third party reviewers looking at this at the request of the fire department for example. as the director mentioned we brought this number down and just to give you a perspective. we were upwards in security and other costs and we are down to 164.5. and the rva item is down from 64 million to 56 million that is what the recommendation of going to a metal skin. we went from the gt ceiling making it metal ceiling making it safer and we recommend going to a glass skin to a metal skin which will be lovely as well and we will show you the rendering. we have just about cut as much as we could possibly cut but do think that it is important to present the information that kim requested and we will do that at the next meeting. we are

. commissioners? >> i also think that the proximity limit is going to be just as useful as the total ban. i sympathize in terms of, we need to, you know, think about daytime use, and that balance, and if there is an overwhelming amount of night-time businesses only. we do need to have a balance that helps keep it lively during the daytime also. also, in terms of cus, you know, let's face it, we just don't have any enforcement. you know, we are just under budgeted and we just don't have it. so, i would agree with my other commissioners that a proximity ban would be appropriate and a less let's droconian and would i think, achieve that balance. >> commissioner riley? >> yes, i agree. and i think that the objective is to make sure that we provide the opportunity for other businesses coming in to the proximity controls would be able to accomplish that. once you pass the ban, i assume that it would take a long time and a lot of process in order to lift the ban. is that right? >> i also heard the legislative aid right there that they are willing to go back and also talk to the planning department

the contingentcies and reserves that will allow us to complete the delivery of the phase one program. and so, within the budget today. there are a number of components of contingentcies and reserves within the budget and the first is the design contingentcy. >> it is embedded within the construction costs budgets and it represents a reserve for unknowns in the design at any status and any point in the design process. so that the typical expectation is that as you move through the design process, those design contingentcies, are reduced to 0. but at the same time, additional detail comes in to the design and is reflected in the design documents that off-sets that contingentcy. our contingentcies are not currently at 0 as we have not completed the design. but, we are carrying roughly $8 million in the design contingentcy bucket at this point. the second category again is within the construction budget is the construction contingentcy and that is a reserve that is held for the course of construction, unforeseen conditions and other change ts in the scope or construction requirements. and the reserve, a
for the program. we would really like to get away from using a letter of credit. because it costs money, number one and it is duplicative to the money in the self-insurance fund and it will help to stream line the process for not only the city, the administrator and the contractors. and so we are looking at alternatives to the letter of credit of being able to issue some form of collateral that is effective to the surty companies to keep the program going in a stream lined fashion. we are going to continue to review the processes for efficiency and effectiveness. there will be further 14 d clean upcoming up down the line and we will be using that process to make additional recommendations to the program efficiencies. in this current legislation, we just wanted to make sure that deal with what we consider to be some what of a no brainer, in that it does, it has a very immediate impact with without a whole lot of down side. and essentially. and then, we are also going to take a look at options to increase the types of contracts that are allowed to participate in the program, we are also partnerin
